Terms of Service

📜 1. Acceptance of Terms

By accessing or using Enchanted Reads ("the Service"), including our web application and iOS mobile application, operated by Enchanted Reads ("we," "our," or "us"), a company registered in the Province of British Columbia, Canada, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Enchanted Reads. By creating an account, completing a purchase, or otherwise using any part of the Service, you affirm your acceptance of these Terms and our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

🛡️ 2. Eligibility

You must be at least sixteen (16) years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this minimum age requirement. If you are between the ages of 16 and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

We reserve the right to request verification of age at any time and to suspend or terminate accounts where we reasonably believe the user does not meet the minimum age requirement.

✨ 3. Description of Service

Enchanted Reads is a full-featured book reading and library management platform available as a web application and a native iOS application. The Service provides users with tools to:

• Book Management — Add, organize, and track books across physical, ebook, and audiobook formats with detailed metadata, ratings, and cover images.
• Library Organization — Arrange books using a visual bookshelf, create themed bookcases and collections, and track book series.
• Reading Tracking — Manage a To-Be-Read (TBR) list, log reading sessions with progress, track Did Not Finish (DNF) records, and monitor rereads and reading streaks.
• Reviews & Content — Write detailed reviews with annotations, track characters and quotes, tag tropes, upload image galleries, and interact with other reviews via reactions and comments.
• AI Features — Generate AI character portraits (Soul Portraits), AI book spine images, use the Enchanted Oracle AI chat assistant, and receive AI-powered suggestions for book details and reviews.
• Social Features — Connect with other readers through friend requests, follows, public profiles, book clubs, buddy reads, leaderboards, and real-time notifications.
• Achievements & Gamification — Earn achievements across multiple tiers (Bronze, Silver, Gold, Platinum), track progress, collect titles, and participate in reading challenges.
• Reading Analytics — Access reading goals, weekly and monthly digests, reading insights, year-in-review summaries, and community percentile comparisons.

The Service may be modified, updated, or enhanced at any time. We reserve the right to add, change, or discontinue features or functionality with or without notice, provided that material changes affecting paid subscribers will be communicated in advance.

🔑 4. Account Registration

To access certain features of the Service, you must create an account. You may register using an email address and password, or through supported third-party OAuth providers (currently Google and Apple). By creating an account, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain and promptly update your account information to keep it accurate and current.
• Maintain the confidentiality and security of your password and login credentials.
• Accept full responsibility for all activities that occur under your account.
• Notify us immediately at [email protected] of any unauthorized use of your account or any other security breach.
• Create and maintain only one account per person. Multiple accounts for the same individual are not permitted.

We reserve the right to suspend or terminate accounts that we reasonably believe contain inaccurate information, are duplicates, or have been created in violation of these Terms.

💳 5. Subscriptions & Payments

5.1 Subscription Tiers

The Service offers four subscription tiers, each with different feature limits (including the number of books, bookcases, AI generation credits, and storage capacity):

• Apprentice (Free) — Basic access to core features with limited functionality.
• Mage (Basic) — Enhanced features including expanded limits and additional capabilities.
• Archmage (Premium) — Full-featured access with generous limits and advanced features.
• Grand Wizard (VIP) — Maximum access with the highest limits and all premium features.

Detailed feature comparisons and current pricing for each tier are available on our pricing page within the Service. Feature limits per tier (including the number of books, bookcases, AI generations per day, and storage allocations) are specified on the pricing page and may be updated from time to time.

5.2 Billing & Auto-Renewal

Paid subscriptions are billed in advance on a recurring monthly or annual basis (depending on the billing cycle you select at the time of purchase). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us (or the applicable platform) to charge the applicable fee to your chosen payment method on a recurring basis.

5.3 Payment Methods

• Web Application: Payments are processed securely through Stripe. You must provide a valid payment method (credit card, debit card, or other supported method) to subscribe to a paid plan via the web.
• iOS Application: Payments are processed through Apple In-App Purchase (StoreKit 2). iOS subscriptions are subject to Apple’s terms and conditions, including Apple’s App Store Review Guidelines and subscription policies.

5.4 Free Trials

We may offer a seven (7) day free trial for new paid subscribers. At the end of the trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged unless you cancel before the trial expires. Free trials are limited to one per person and may not be combined with other promotional offers.

5.5 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. After the billing period concludes, your account will revert to the Apprentice (Free) tier. No prorated refunds will be issued for partial billing periods, except where required by applicable law.

5.6 Price Changes

We reserve the right to adjust subscription pricing. Any price changes will be communicated to you at least thirty (30) days in advance via email or in-app notification. Your continued use of the Service after a price change takes effect constitutes acceptance of the new pricing. If you do not agree to the updated pricing, you may cancel your subscription before the change takes effect.

5.7 Refunds

Refunds are handled in accordance with applicable law and the policies of the platform through which you subscribed. For web subscriptions processed through Stripe, refund requests may be submitted to [email protected]. For iOS subscriptions, refunds are governed by Apple’s App Store refund policy, and requests must be submitted directly to Apple.

📝 6. User Content

6.1 Ownership

You retain all ownership rights to the content you create and submit through the Service, including but not limited to: book reviews, annotations, notes, character descriptions and appearance details, quotes, trope tags, collections, bookcases, images you upload, and any other original content ("User Content").

6.2 License Grant

By submitting User Content to the Service, you grant Enchanted Reads a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and store your User Content solely for the purpose of operating, providing, improving, and promoting the Service. This license continues for as long as your User Content remains on the Service and for a reasonable period thereafter to allow for data removal from backups and caches.

6.3 Public Content

Certain features of the Service allow you to make content publicly visible, including public user profiles, public bookcases, and shared reviews. Content you designate as public will be accessible to other users of the Service and potentially to search engines and third parties. You are solely responsible for managing the visibility settings of your content. We provide visibility controls (such as public, friends-only, and private settings) to help you manage what is shared.

6.4 Content Moderation

We reserve the right (but have no obligation) to review, monitor, edit, or remove any User Content that, in our sole discretion, violates these Terms, is objectionable, or may harm the Service or other users. We may also disclose User Content if required by law or if we believe disclosure is necessary to protect our rights, the safety of our users, or the public.

🧠 7. AI-Generated Content

The Service incorporates artificial intelligence features powered by third-party providers (including OpenAI). By using AI features, you acknowledge and agree to the following:

7.1 Soul Portraits (Character Images)

Soul Portraits are AI-generated character images created based on user-provided character descriptions and appearance fields. These images are generated using OpenAI’s image generation models. AI-generated images may not be subject to copyright protection under applicable law. You acknowledge that you may not have exclusive ownership or copyright over AI-generated images. Character appearance data may be cached globally to improve consistency across the Service (for example, to ensure the same character looks consistent across different users’ reviews within the same book series).

7.2 Spine Generation

AI-generated book spine images are created using OpenAI’s image generation capabilities. The same copyright considerations described above for Soul Portraits apply to spine images.

7.3 Enchanted Oracle Chat

The Enchanted Oracle is an AI chatbot available in three modes: Book Companion, Reading Buddy, and Librarian AI. Responses generated by the Oracle are for entertainment and informational purposes only and do not constitute professional, literary, or any other form of expert advice. The accuracy of AI-generated responses is not guaranteed.

7.4 AI Assist

AI Assist provides automated suggestions for book details, review content, and other features. These suggestions are generated by AI models and may contain errors or inaccuracies. You are responsible for reviewing and editing any AI-generated suggestions before incorporating them into your content.

7.5 Usage Limits & Fair Use

AI feature usage is subject to daily generation limits that vary by subscription tier. These limits are in place to ensure fair access for all users and to manage the costs of third-party AI services. Current limits are displayed within the Service. We reserve the right to adjust these limits at any time.

🤝 8. Community Standards & Acceptable Use

Enchanted Reads is a community of readers. To maintain a safe and welcoming environment, you agree to the following when using the Service:

8.1 Prohibited Conduct

You agree not to:

• Post or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Engage in hate speech, discrimination, or harassment of any kind based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload or transmit malware, viruses, or any other harmful code.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems.
• Use the Service for any commercial purpose not expressly permitted by these Terms.
• Spam, solicit, or send unsolicited communications to other users.
• Scrape, crawl, or use automated tools to collect data from the Service without our express written consent.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Violate any applicable local, provincial, national, or international law or regulation.

8.2 Content Warnings

The Service provides a content warnings system to help users identify potentially sensitive material. We encourage all users to tag appropriate content warnings on their reviews and content. While we strive to maintain accurate content warnings, we cannot guarantee their completeness. Users may vote on the accuracy of content warnings to improve the system for the community.

8.3 Social Features & Community Conduct

When using social features (including friend requests, follows, book clubs, buddy reads, leaderboards, and public profiles), you must conduct yourself respectfully. Abuse of social features, including but not limited to mass unsolicited friend requests, follow/unfollow manipulation, or disruptive behavior in book clubs, may result in restrictions on your account or termination.

8.4 Reporting

We provide in-app reporting tools for users to flag content or behavior that violates these Terms or our community standards. We will review reports in a timely manner and take appropriate action, which may include content removal, account warnings, temporary suspension, or permanent termination. False or malicious reporting may itself be considered a violation of these Terms.

©️ 9. Intellectual Property

The Service, including its design, user interface, graphics, logos, branding, features, software, documentation, and all content created by Enchanted Reads (excluding User Content and AI-generated content), is the exclusive property of Enchanted Reads and is protected by copyright, trademark, trade secret, and other intellectual property laws of Canada and international treaties.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or create derivative works based on the Service or any part thereof without our prior written consent.

The Enchanted Reads name, logo, and all related product and service names, design marks, and slogans are trademarks of Enchanted Reads. You may not use these marks without our prior written permission.

🔗 10. Third-Party Services

The Service integrates with and relies upon various third-party services. Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services. The third-party services we currently use include, but are not limited to:

• Stripe — Payment processing for web subscriptions.
• Apple (StoreKit 2 / In-App Purchase) — Payment processing for iOS subscriptions.
• Google OAuth & Apple Sign-In — Third-party authentication providers.
• OpenAI — AI-powered features including Soul Portraits, spine generation, Oracle Chat, and AI Assist.
• DigitalOcean — Cloud infrastructure and file storage.
• Telegram — Optional notification delivery and account linking.
• Google Analytics — Usage analytics and performance monitoring.

We may add or change third-party service providers at any time. The availability of third-party integrations is not guaranteed, and disruptions to third-party services may affect certain features of the Service.

You agree to indemnify, defend, and hold harmless Enchanted Reads and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any third party’s rights, including intellectual property rights or privacy rights.

🚪 14. Termination

14.1 Termination by Enchanted Reads

We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or if continued access poses a risk to the Service, other users, or our business. In the case of minor or first-time violations, we will endeavour to provide a warning before suspension or termination, but we are not obligated to do so.

14.2 Termination by You

You may terminate your account at any time by using the account deletion feature within the Service or by contacting us at [email protected]. We recommend that you export your data before deleting your account, as deletion is permanent and your data cannot be recovered.

14.3 Effect of Termination

Upon termination, your right to access and use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms). Sections of these Terms that by their nature should survive termination will continue to apply, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.

⚖️ 15. Dispute Resolution

15.1 Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15.2 Jurisdiction

You agree that the courts of the Province of British Columbia, Canada, shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or your use of the Service. You irrevocably consent to the personal jurisdiction and venue of such courts.

15.3 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute through good faith negotiation within thirty (30) days. If the dispute is not resolved within this period, either party may pursue formal legal action.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent. If modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions.

📚 17. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Enchanted Reads with respect to your use of the Service. These Terms supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral, regarding the Service.

🔄 18. Changes to Terms

We reserve the right to modify or replace these Terms at any time. For material changes, we will provide at least thirty (30) days’ prior notice via email (to the address associated with your account) or through a prominent notice within the Service. Non-material changes may take effect immediately upon posting.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
